Selon les spectateurs, la vitesse de la voiture est environ entre 100 et 150 km/h, la victime est heurté environ 5m haut, 20m loin.&lt;br /&gt;&lt;br /&gt;Extérieurement, c'est un accident normal, en effet, non.&lt;br /&gt;&lt;br /&gt;Le conducteur de la voiture, HU Bin, n'a arrêté pas, et puis, les autres voitures sportives sont arrivées. Ils ont été en train de competiter sur les routes dans une ville. Ils ont moque, téléphone, comme rien est passe. 10 minutes après, la mère de HU Bin est arrivé, elle a toujours téléphoné sans arrêt, à peu près 40 minutes.&lt;br /&gt;&lt;br /&gt;Cet accident est discuté sur Internet rapidement, le lendemain, toute la chine le sait. Le lendemain, 8 Mai, le commissariat de Hangzhou a lancé une conférence de presse. Les polices ont déclaré que:&lt;br /&gt;&lt;ul&gt;&lt;ul&gt;&lt;li&gt;Selon les autres conducteurs, des amis de HU Bin, la vitesse de la voiture de HU Bin est environ 70 km/h.&lt;/li&gt;&lt;li&gt;HU Bin et ses amis n'ont pas conduit compétitement.&lt;/li&gt;&lt;/ul&gt;&lt;/ul&gt;Après la conférence, tous les journaux et émission tv à Hangzhou sont silences, pas de grand rapport sur cet accident. Sur Internet, "19 Lou", le forum plus connu à Hangzhou, a supprimé tout le poste sur cet accident.&lt;br /&gt;&lt;br /&gt;Mais les autres forums chinois, il y a beaucoup de discussions. On a trouvé beaucoup des choses intéressantes:&lt;br /&gt;&lt;ul&gt;&lt;ul&gt;&lt;li&gt;La limitation de la vitesse est 50km/h, en Chine, excès de vitesse plus que 50%&lt;br /&gt;est le crime non seulement trafic, mais aussi crime social. La punition est différente. Les polices dissent la vitesse est 70km/h est pour HU Bin évite la punition. &lt;/li&gt;&lt;li&gt;Après l'accident, HU Bin n'a été pas contrôlé par les polices, mais retourné chez lui, sans aucun de souci, et écrit un article dans son blog. &lt;/li&gt;&lt;li&gt;En 2008, HU Bin a conduit 210 km/h sur autoroute, normalement, son permis de conduire doit être résilié, mais, il conduit sans aucun de problème jusqu’à aujourd’hui.&lt;/li&gt;&lt;li&gt;Le père de HU Bin est un grand parton à Hangzhou. Quelque poste indique il a donné plus un million RMB (environ cent mille euros) au commissariat Hangzhou, mais on ne sait pas la vérité. (à mon avis, c'est la vérité)&lt;/li&gt;&lt;li&gt;Un des conducteurs, qui conduit une Ferrari, est le fis du ministre de Propagation Bureau Hangzhou, qui a le droit de contrôler tout les media à Hangzhou. Cela explique pourquoi les journaux et les tv sont silences. (13 Mai, le gouvernement Hangzhou déclare que ce n’est pas vrai, mais personne ne le croit.)&lt;/li&gt;&lt;/ul&gt;&lt;/ul&gt;&lt;p&gt;L'image ironique cet événement. Même si vous conduit 100 km/h, si vous avez l’argent et pouvoir, vous pouvez changer la vérité. &lt;/p&gt;&lt;p&gt;Ça, c’est la vrai chine, un pays sans liberté, sans égalité, sans droit d’homme. /&gt;台灣還需要言論自由日嗎？&lt;br /&gt;&lt;br /&gt;蔡英文在參加鄭南榕追思晚會時說，民進黨立院黨團將提案，把4月7日訂為國定的「言論自由日」，為的是「讓大家永遠記住鄭南榕為台灣所做的一切」。&lt;br /&gt;&lt;br /&gt;鄭南榕算不算是對言論自由做出重大貢獻的人，見仁見智，不在我這次討論的範圍。我也不反對民進黨年年為他舉辦紀念會，但是不太懂蔡英文所說的：「我們需要更多的鄭南榕」。大家都知道，鄭南榕是為了抗議當時言論不自由，而自焚身亡。但那是在威權時代，人民沒途徑向政府抗爭。如今早已不需要使用如此激烈的行為，就能達到抗爭的目的。&lt;br /&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;現在在台灣，人民可以包圍總統府，直接叫總統下台；媒體可以指著總統的鼻子照三餐罵；在野黨可以說要推翻中華民國，罷免總統&lt;/span&gt;，我不知道台灣還需要怎樣的言論自由。&lt;br /&gt;&lt;br /&gt;如果民進黨主席認為，台灣還需要一個言論自由日，是不是代表她承認儘管民進黨執政了八年，台灣的言論仍然不自由？還是認為只有民進黨才有專利可以保障台灣的言論自由。&lt;br /&gt;&lt;br /&gt;蔡英文還說，「國民黨政權是一個沒有改造的威權體制、保守政權」，更是故意扭曲事實。&lt;span style="color:#ff0000;"&gt;國民黨執政，是人民一票一票選出來的&lt;/span&gt;，哪裡威權了？民進黨這次台南縣長提名由黨中央指派，那才叫威權。批國民黨保守，民進黨對兩岸關係又做了什麼開放的事。&lt;br /&gt;&lt;br /&gt;民進黨不反省自己在這些年來，頻頻用意識型態區分敵我，動輒搜索媒體，威脅要關電視台，囂張的要人民拒看批評他們的報紙。還有什麼臉說要阻止台灣「重返保守壓抑的社會」，這不是惡人先告狀嗎？&lt;span style="color:#ff0000;"&gt;蔡英文自己在台上就已經感受到台灣多元的言論自由，有人給她加油，有人嗆她下台，這不就是台灣言論自由的最高度表現。&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;台灣因政治目的而制定的國定節日已經太多，更何況對言論自由付出心力的，也不止鄭南榕一人。所以，民進黨與其使出為言論自由制訂一個節日的虛招，還不如以身作則的做出點保障異己言論自由的事，好讓台灣人見賢思齊。免得被人看破此舉動機不良，只是為了政治鬥爭。&lt;br /&gt;&lt;br /&gt;====================&lt;br /&gt;&lt;br aujourd'hui, environ 40km aller-retour. J'ai dépensé 5 heures. Les paysage sont très belle. /&gt;&lt;br /&gt;我希望政治家們，都能夠在制定任何政策前，仔細斟酌是否會傷害任何人、生物與土地。而且，對自己的所作所為，負起應有的責任，誠實面對應有的歷史評價。而且，如果在政治家自甘墮落為廉價的政客，無法達成以上期待，甚至對社會造成傷害的時候，我們可以有效地加以譴責，並很輕而易舉地找到取代他們的對象或者制裁他們的方法。&lt;br /&gt;&lt;br /&gt;我希望，再也不要有，當整個社會上的大多數人，都在安穩地酣睡的時候，少數弱勢群體的家園和世界，卻在鎮暴盾牌與破壞機具前崩潰。再也不會有，只為了成就某些錯誤的決策，犧牲掉農民、工人、學生、漢生病人、原住民、同志社群與其他任何人的幸福與安居樂業的小小夢想。&lt;br /&gt;&lt;br /&gt;我希望，無論是移工、嫁娶、移民、流亡到這塊土地上的任何人，無論國籍有無、地位高低、宗教信仰如何，都能免於餐風露宿或驅趕隔離，並且能受到政府與社會良好的接納與照顧。&lt;br /&gt;&lt;br /&gt;我希望，再也不要有，經營者在大環境不佳的背景掩護之下，惡意地將員工任意資遣，還透過掩飾離職原因，美化裁員狀況，不讓他們能夠獲得完整的失業補助，任這些為企業付出青春與勞力的人獨自面對生命危機。我也希望，公權力能夠像保衛自己的利益那樣地保護所有人，包括那些除了一紙解雇通知以外一無所有的人。&lt;br /&gt;&lt;br /&gt;我希望，不要再有貓、狗，甚至其他任何動物被虐待，被棄養，被為了商業目的刻意地繁殖之後又任其走向毀滅。我希望，在所費不貲由極端脆弱的明星動物之外，也能有同等甚至更多的資源，讓台灣成為一個對所有動物友善的島嶼，並且有效、確實地制裁那些以虐待甚至虐殺動物為樂的人類渣滓，以及任意拋棄同伴動物的無責任飼主，並且令這些人付出代價，受到相應的懲罰。&lt;br /&gt;&lt;br /&gt;我希望，我們的媒體與新聞工作者，能夠得到他們應有的社會地位與專業尊重。我希望新聞能夠盡可能地擺脫政治力的影響，並且不被視為一種可以交易的商品，並且能夠有較現在更佳的廣度與深度。我希望，可以不再透過剪貼與抄襲，成就一份報導，也可以不需要透過一再地引起爭議，並炒作某些事實上不具意義的假議題，來吸引閱聽大眾的目光。&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;你有希望，我有希望，只是大部分都還未解決。&lt;br /&gt;&lt;br /&gt;有時，懷抱這些希望，就像是中古時代建造大教堂的工匠，我們可能要理解到，我們在從事一項有生之年很難看見成果的工作，但我們還是繼續下去，因為懷抱著某種使未來世代更美好的模糊理想。儘管它可能顯得不夠實際，但是卻非常有誠意。&lt;br /&gt;&lt;br type='html'>&lt;p&gt;回顾了大红灯笼高高挂，对于结尾处西皮流水的一段很有兴趣，搜索了一下关于其中的京剧唱段的背景知识，找到一篇博文：&lt;/p&gt;&lt;p&gt;原始链接：&lt;a href="http://knospe77.blog.163.com/blog/static/48936367200865101551386/"&gt;http://knospe77.blog.163.com/blog/static/48936367200865101551386/&lt;/a&gt;&lt;/p&gt;&lt;p&gt;一个朋友跟我说起《大红灯笼高高挂》中有不少京剧唱段，赶上我闲着，就从网上重温了一遍这部电影。随手记下片中出现过的京剧唱段，胡乱说说。&lt;br /&gt;影片30分钟左右，老爷住在四太太房里，三太太又以病为由来请老爷，老爷没去。第二天天不亮，传来了三太太唱戏的声音，三太太唱的就是这段：《红娘》——四平调看小姐做出来许多破绽，对红娘偏用着要巧语花言。 本来是千金体大家风范，最可怜背人处红泪偷弹。盼佳期数不尽黄昏清旦，还有个痴情种呀废寝忘餐。非是我愿意儿传书递简，有情人成眷属不羡神仙。&lt;br /&gt;前面三句在片中是用一种遥远的声音唱出来的，不仔细听几乎听不清，说明前三句与剧情关系不大。第四句“背人处红泪偷弹”却是渐渐清晰，随后落实在三太太梅珊一身红帔上。她穿的并不是红娘的行头，所以唱出的也不是红娘的话，而是她自己的心声。“盼佳期”无非是盼“捶脚”，至于最后“有情人成眷属不羡神仙”则是梅珊的美好愿意了。&lt;br /&gt;38分钟，颂莲跟老爷呕气，老爷去了三太太院子里。四太太一人神情落没地走在楼顶上，传来三太太的声音：《红娘》——西皮流水叫张生隐藏在棋盘之下，我步步行来你步步爬。放大胆忍气吞声休害怕，这件事倒叫我心乱如麻。可算得是一段风流佳话，听号令且莫要惊动了她。&lt;br /&gt;片中演唱的流水节奏比正常的似乎都要慢许多，不知道为什么。不过要不这样观众们也许听不清楚了。这段流水在京剧中的情节是红娘引着张生去会莺莺，而在片中的隐语则像是三太太对她的相好高医生的心里话。特别是这段流水中第四句，通常唱法是“跟随我小红娘就能见着她”，当然也有唱成现在这种“心乱如麻”的，因为这个词形容红娘的心情似乎不是太准确，但形容三太太梅珊的心情则再准确也没有了。&lt;br /&gt;紧接着又唱了《苏三起解》，是二重唱，但只唱了两句。与此同时，四太太发现了那间“死人屋”：《女起解》——西皮流水苏三离了洪洞县，将身来在大街前。。。&lt;br /&gt;这段大概是为了让情节更加流畅些，似乎没有太多的深意。&lt;br /&gt;52分钟左右，在三太太房中打麻将时，高医生播放三太太当年的演出录音：《御碑亭》——西皮导板转散板一见休书如刀绞，只为归家那一宵。行至中途风雨暴，碑亭避雨起祸苗。那边又来一年少，两厢无言坐一宵。清清白白我得贞节保，儿得娘啊！谁知他疑心起风潮！&lt;br /&gt;这段就有意思了。《御碑亭》是说孟月华因雨夜与一陌生男子在御碑亭共处而被丈夫疑心，被休弃，后来真相大白的故事。这段唱是孟月华冤屈得申时对丈夫说的话。有趣的是，在这个桥段中这唱段只放到“两厢无言坐一宵”，后面的两句没放。结合当时梅珊与高医生的奸情，像是梅珊的诺言，又像是一种暗暗的讽刺。&lt;br /&gt;89分钟左右，四太太假孕暴露，被封了灯，而她为了惩罚泄密的雁儿，揭发了雁儿自己在屋中点灯笼的事儿。雁儿受罚后，二院点灯，三太太在楼顶上唱：《桃花村》——西皮流水非是我嘱咐叮咛把话讲，只怪你呆头呆脑慌慌张张。 今夜晚非比那西厢待月，你紧提防，莫轻狂， 关系你患难鸳鸯，永宿在池塘。 已然错情生波浪，怎能够粗心大意你再荒唐。 鼓打二更准时往，桃花村口莫彷徨。 你不要高声也不要嚷，你必须眼观四路耳听八方。。。&lt;br /&gt;其实后面还有几句，但片中没唱完，因为要用戏说的话已经说清楚了。这段是梅珊在警劝颂莲。前两句完全就是片中人的口气，是一种友好的嗔怪，语气情绪都精准到位；第三句不知是不是有意与前面的《红娘》唱段想呼应，居然还提到了“西厢待月”；第五、六句，“鸳鸯永宿在池塘”则是提醒颂莲的人生目标；往下几句也全是对颂莲的提醒与劝告。这段唱与影片情节帖合得特别好。&lt;br /&gt;然后颂莲说出名言：这院儿里人像什么？像狗像猫像耗子，就是不像人。&lt;br /&gt;115分钟左右，梅珊死后“闹鬼”原是四太太在放留声机，就是《御碑亭》的唱段，先唱的是前面播放过的那段西皮导板转散板，声音很悠远，隐隐传来，不过这次带上了最后两句的哭头，“儿得娘啊！谁知他疑心起风潮！”这句听得特别清楚，似乎是梅珊的悲啼。接下来又唱了这段快板：《御碑亭》——西皮快板（原系生旦对唱，但此中只留了旦角部分）自幼父母娇生养，盈盈十五嫁王昌。既读诗书你不思量，奴岂是柳絮就随风扬。风雨难测人难量，暗室何必日月光。阴谋毒计良心丧，休书好比杀人场。手摸胸膛想一想，无义的王魁比你强。&lt;br /&gt;这段前四句是单人演唱，后面六句则由女声合唱，而且反复了三次，与其说是梅珊对老爷的斥责，对二太太的控诉，不如说是颂莲的呐喊。&lt;br /&gt;《大红灯笼高高挂》是部不错的电影，多年后的今天重新来看也还是不错。片中有大量的京剧元素，不仅是这些唱段，还有在远景中大量使用的京剧锣鼓、哼唱等等，让京剧锣鼓这种外化的情绪与宏大的环境场面相结合，人、情、景、声融为一体，好！&lt;/p&gt;&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' Then they ground down the pills and forced the powder into my mouth with a syringe&lt;br /&gt;Sun Fa Wu, 57In Shandong province, a small group of people claim they were locked up in a mental institution against their will after they dared to complain about the way the authorities treated them.&lt;br /&gt;They now have the satisfaction of knowing their claims are being discussed on internet bulletin boards throughout the country.&lt;br /&gt;And, unusually, their complaints have surfaced in the state media.&lt;br /&gt;They were featured in an investigation by a Beijing newspaper into the treatment of "petitioners" - those who travel to the capital to air their grievances and petition the central authorities for their support.&lt;br /&gt;The group, both men and women in their 40s or older, had different motives when they began petitioning, but all now have the same complaint: that they were detained illegally by the local officials they sought to expose.&lt;br /&gt;They gather in a small insurance office next to a dusty road to tell their stories. Each is taking considerable risk in talking to a foreign journalist. All have been told in the past to "stop making trouble".&lt;br /&gt;'Manhandled'&lt;br /&gt;One man, Sun Fa Wu, is a 57-year-old with neatly styled grey hair, wearing a dark blue "Sun Yat Sen" suit.&lt;br /&gt;He says he was locked up in the local mental asylum for three weeks in October after travelling to Beijing to petition officials there over damage to his land caused by mining.&lt;br /&gt;As he describes how the doctors forced him to take medication, he twists and contorts his body to demonstrate how they manhandled him and grabs his own throat to show how he was forced to swallow the drugs.&lt;br /&gt;"They took me to the ward and tied me to the bed," he says. "They pulled my hair and blindfolded me when I struggled. Then they ground down the pills and forced the powder into my mouth with a syringe."&lt;br /&gt;His family pleaded with doctors to release him, he says. His mother was dying. Eventually his brother went down on his knees in front of the officials at the local council offices and begged them to let Mr Sun out of the asylum before his mother died.&lt;br /&gt;They agreed, but it was too late. She had passed away.&lt;br /&gt;'You will not win'&lt;br /&gt;Another woman pushes forward, and spreads out photographs of her younger sister on the table. The pictures show a woman who has been badly beaten. There are huge welts and bruises all over her body.&lt;br /&gt;&lt;br /&gt;Ms Xu says she was complaining about her sister's assault by policeThe woman telling her story - Xu Xue Ling, 46 - says her sister was beaten three times by the police. She started petitioning the authorities in Beijing to complain.&lt;br /&gt;Eventually she was picked up in the Chinese capital and brought back to the mental asylum in the Xintai district.&lt;br /&gt;That was in May. She was locked up there for six days.&lt;br /&gt;"I told the doctors I was not a lunatic," the woman says. "I was just seeking justice for my sister. They said the local government has said you are a lunatic and they have paid money. If you want to fight the Communist Party you will not win."&lt;br /&gt;These are serious allegations that are, at this stage, impossible to verify.&lt;br /&gt;Staff the BBC spoke to at the mental asylum said they were not allowed to comment, although earlier on the phone they had denied flatly the claims of the petitioners.&lt;br /&gt;The director's office inside the main block is a shabby, bare room with two desks and five files sitting in a neat row. There is no phone, no computer.&lt;br /&gt;Shabby&lt;br /&gt;Across a yard is the building where the patients are kept. Staff say there are 71 at present, housed in two wings, one for men and one for women. It is a shabby, run-down building.&lt;br /&gt;&lt;br /&gt;The asylum's director did not want to talk to the BBC"Most of our patients come from rural areas," staff members explain. "There isn't much money to care for them."&lt;br /&gt;A few patients can be seen in the shadows as the afternoon light fades, shuffling along aimlessly, sometimes pausing to look out of the window.&lt;br /&gt;The staff said the asylum's director, Dr Wu, would appear "soon" to give his side of the story, but after a three-hour wait there was no sign of him.&lt;br /&gt;Later our driver told us he had seen several official-looking vehicles sweep out of the compound earlier. There were lots of police vehicles around.&lt;br /&gt;It appeared we were duped, perhaps kept out of the way while officials from various bodies who had been meeting at the hospital could leave unobserved.&lt;br /&gt;All further inquiries were referred to the local government offices in Xintai. There an official in the information office, Mr Sun, said that the council had set up an investigation team after they had seen the Beijing newspaper's report.&lt;br /&gt;"Once that was completed," he said, "they will be able to tell people the truth."&lt;br /&gt;No reprisals&lt;br /&gt;Chinese government officials recently let it be known that they would allow articles to be published in the state media that were more critical of the establishment.&lt;br /&gt;The reporter who compiled the investigation for the Beijing News, Huang Yuhao, told the BBC that so far there had been no reprisals directed against him or his newspaper.&lt;br /&gt;The petitioners in Xintai say they have nothing left to fear from speaking out. They complain that they have suffered greatly already. They have chosen December 10, the anniversary of the Universal Declaration of Human Rights, as the day on which to express their political ideas and to outline their vision of a constitutional, democratic China. They intend “Charter 08” to serve as a blueprint for fundamental political change in China in the years to come. The signers of the document will form an informal group, open-ended in size but united by a determination to promote democratization and protection of human rights in China and beyond.&lt;br /&gt;On December 8 two prominent signers of the Charter, Zhang Zuhua and Liu Xiaobo, were detained by the police. Zhang Zuhua has since been released; as of December 9, Liu Xiabo remains in custody.&lt;br /&gt;—Perry LinkCharter 08&lt;br /&gt;I. ForewordA hundred years have passed since the writing of China’s first constitution. 2008 also marks the sixtieth anniversary of the promulgation of the Universal Declaration of Human Rights, the thirtieth anniversary of the appearance of Democracy Wall in Beijing, and the tenth of China’s signing of the International Covenant on Civil and Political Rights. We are approaching the twentieth anniversary of the 1989 Tiananmen massacre of pro-democracy student protesters. The Chinese people, who have endured human rights disasters and uncountable struggles across these same years, now include many who see clearly that freedom, equality, and human rights are universal values of humankind and that democracy and constitutional government are the fundamental framework for protecting these values.&lt;br /&gt;By departing from these values, the Chinese government’s approach to “modernization” has proven disastrous. It has stripped people of their rights, destroyed their dignity, and corrupted normal human intercourse. So we ask: Where is China headed in the twenty-first century? Will it continue with “modernization” under authoritarian rule, or will it embrace universal human values, join the mainstream of civilized nations, and build a democratic system? There can be no avoiding these questions.&lt;br /&gt;The shock of the Western impact upon China in the nineteenth century laid bare a decadent authoritarian system and marked the beginning of what is often called “the greatest changes in thousands of years” for China. A “self-strengthening movement” followed, but this aimed simply at appropriating the technology to build gunboats and other Western material objects. China’s humiliating naval defeat at the hands of Japan in 1895 only confirmed the obsolescence of China’s system of government. The first attempts at modern political change came with the ill-fated summer of reforms in 1898, but these were cruelly crushed by ultraconservatives at China’s imperial court. With the revolution of 1911, which inaugurated Asia’s first republic, the authoritarian imperial system that had lasted for centuries was finally supposed to have been laid to rest. But social conflict inside our country and external pressures were to prevent it; China fell into a patchwork of warlord fiefdoms and the new republic became a fleeting dream.&lt;br /&gt;The failure of both “self-strengthening” and political renovation caused many of our forebears to reflect deeply on whether a “cultural illness” was afflicting our country. This mood gave rise, during the May Fourth Movement of the late 1910s, to the championing of “science and democracy.” Yet that effort, too, foundered as warlord chaos persisted and the Japanese invasion [beginning in Manchuria in 1931] brought national crisis.&lt;br /&gt;Victory over Japan in 1945 offered one more chance for China to move toward modern government, but the Communist defeat of the Nationalists in the civil war thrust the nation into the abyss of totalitarianism. The “new China” that emerged in 1949 proclaimed that “the people are sovereign” but in fact set up a system in which “the Party is all-powerful.” The Communist Party of China seized control of all organs of the state and all political, economic, and social resources, and, using these, has produced a long trail of human rights disasters, including, among many others, the Anti-Rightist Campaign (1957), the Great Leap Forward (1958–1960), the Cultural Revolution (1966–1969), the June Fourth (Tiananmen Square) Massacre (1989), and the current repression of all unauthorized religions and the suppression of the weiquan rights movement [a movement that aims to defend citizens’ rights promulgated in the Chinese Constitution and to fight for human rights recognized by international conventions that the Chinese government has signed]. During all this, the Chinese people have paid a gargantuan price. Tens of millions have lost their lives, and several generations have seen their freedom, their happiness, and their human dignity cruelly trampled.&lt;br /&gt;During the last two decades of the twentieth century the government policy of “Reform and Opening” gave the Chinese people relief from the pervasive poverty and totalitarianism of the Mao Zedong era and brought substantial increases in the wealth and living standards of many Chinese as well as a partial restoration of economic freedom and economic rights. Civil society began to grow, and popular calls for more rights and more political freedom have grown apace. As the ruling elite itself moved toward private ownership and the market economy, it began to shift from an outright rejection of “rights” to a partial acknowledgment of them.&lt;br /&gt;In 1998 the Chinese government signed two important international human rights conventions; in 2004 it amended its constitution to include the phrase “respect and protect human rights”; and this year, 2008, it has promised to promote a “national human rights action plan.” Unfortunately most of this political progress has extended no further than the paper on which it is written. The political reality, which is plain for anyone to see, is that China has many laws but no rule of law; it has a constitution but no constitutional government. The ruling elite continues to cling to its authoritarian power and fights off any move toward political change.&lt;br /&gt;The stultifying results are endemic official corruption, an undermining of the rule of law, weak human rights, decay in public ethics, crony capitalism, growing inequality between the wealthy and the poor, pillage of the natural environment as well as of the human and historical environments, and the exacerbation of a long list of social conflicts, especially, in recent times, a sharpening animosity between officials and ordinary people.&lt;br /&gt;As these conflicts and crises grow ever more intense, and as the ruling elite continues with impunity to crush and to strip away the rights of citizens to freedom, to property, and to the pursuit of happiness, we see the powerless in our society—the vulnerable groups, the people who have been suppressed and monitored, who have suffered cruelty and even torture, and who have had no adequate avenues for their protests, no courts to hear their pleas—becoming more militant and raising the possibility of a violent conflict of disastrous proportions. The decline of the current system has reached the point where change is no longer optional.&lt;br /&gt;II. Our Fundamental PrinciplesThis is a historic moment for China, and our future hangs in the balance. In reviewing the political modernization process of the past hundred years or more, we reiterate and endorse basic universal values as follows:&lt;br /&gt;Freedom. Freedom is at the core of universal human values. Freedom of speech, freedom of the press, freedom of assembly, freedom of association, freedom in where to live, and the freedoms to strike, to demonstrate, and to protest, among others, are the forms that freedom takes. Without freedom, China will always remain far from civilized ideals.&lt;br /&gt;Human rights. Human rights are not bestowed by a state. Every person is born with inherent rights to dignity and freedom. The government exists for the protection of the human rights of its citizens. The exercise of state power must be authorized by the people. The succession of political disasters in China’s recent history is a direct consequence of the ruling regime’s disregard for human rights.&lt;br /&gt;Equality. The integrity, dignity, and freedom of every person—regardless of social station, occupation, sex, economic condition, ethnicity, skin color, religion, or political belief—are the same as those of any other. Principles of equality before the law and equality of social, economic, cultural, civil, and political rights must be upheld.&lt;br /&gt;Republicanism. Republicanism, which holds that power should be balanced among different branches of government and competing interests should be served, resembles the traditional Chinese political ideal of “fairness in all under heaven.” It allows different interest groups and social assemblies, and people with a variety of cultures and beliefs, to exercise democratic self-government and to deliberate in order to reach peaceful resolution of public questions on a basis of equal access to government and free and fair competition.&lt;br /&gt;Democracy. The most fundamental principles of democracy are that the people are sovereign and the people select their government. Democracy has these characteristics: (1) Political power begins with the people and the legitimacy of a regime derives from the people. (2) Political power is exercised through choices that the people make. (3) The holders of major official posts in government at all levels are determined through periodic competitive elections. (4) While honoring the will of the majority, the fundamental dignity, freedom, and human rights of minorities are protected. In short, democracy is a modern means for achieving government truly “of the people, by the people, and for the people.”&lt;br /&gt;Constitutional rule. Constitutional rule is rule through a legal system and legal regulations to implement principles that are spelled out in a constitution. It means protecting the freedom and the rights of citizens, limiting and defining the scope of legitimate government power, and providing the administrative apparatus necessary to serve these ends.&lt;br /&gt;III. What We AdvocateAuthoritarianism is in general decline throughout the world; in China, too, the era of emperors and overlords is on the way out. The time is arriving everywhere for citizens to be masters of states. For China the path that leads out of our current predicament is to divest ourselves of the authoritarian notion of reliance on an “enlightened overlord” or an “honest official” and to turn instead toward a system of liberties, democracy, and the rule of law, and toward fostering the consciousness of modern citizens who see rights as fundamental and participation as a duty. Accordingly, and in a spirit of this duty as responsible and constructive citizens, we offer the following recommendations on national governance, citizens’ rights, and social development:&lt;br /&gt;1. A New Constitution. We should recast our present constitution, rescinding its provisions that contradict the principle that sovereignty resides with the people and turning it into a document that genuinely guarantees human rights, authorizes the exercise of public power, and serves as the legal underpinning of China’s democratization. The constitution must be the highest law in the land, beyond violation by any individual, group, or political party.&lt;br /&gt;2. Separation of powers. We should construct a modern government in which the separation of legislative, judicial, and executive power is guaranteed. We need an Administrative Law that defines the scope of government responsibility and prevents abuse of administrative power. Government should be responsible to taxpayers. Division of power between provincial governments and the central government should adhere to the principle that central powers are only those specifically granted by the constitution and all other powers belong to the local governments.&lt;br /&gt;3. Legislative democracy. Members of legislative bodies at all levels should be chosen by direct election, and legislative democracy should observe just and impartial principles.&lt;br /&gt;4. An Independent Judiciary. The rule of law must be above the interests of any particular political party and judges must be independent. We need to establish a constitutional supreme court and institute procedures for constitutional review. As soon as possible, we should abolish all of the Committees on Political and Legal Affairs that now allow Communist Party officials at every level to decide politically-sensitive cases in advance and out of court. We should strictly forbid the use of public offices for private purposes.&lt;br /&gt;5. Public Control of Public Servants. The military should be made answerable to the national government, not to a political party, and should be made more professional. Military personnel should swear allegiance to the constitution and remain nonpartisan. Political party organizations shall be prohibited in the military. All public officials including police should serve as nonpartisans, and the current practice of favoring one political party in the hiring of public servants must end.&lt;br /&gt;6. Guarantee of Human Rights. There shall be strict guarantees of human rights and respect for human dignity. There should be a Human Rights Committee, responsible to the highest legislative body, that will prevent the government from abusing public power in violation of human rights. A democratic and constitutional China especially must guarantee the personal freedom of citizens. No one shall suffer illegal arrest, detention, arraignment, interrogation, or punishment. The system of “Reeducation through Labor” must be abolished.&lt;br /&gt;7. Election of Public Officials. There shall be a comprehensive system of democratic elections based on “one person, one vote.” The direct election of administrative heads at the levels of county, city, province, and nation should be systematically implemented. The rights to hold periodic free elections and to participate in them as a citizen are inalienable.&lt;br /&gt;8. Rural–Urban Equality. The two-tier household registry system must be abolished. This system favors urban residents and harms rural residents. We should establish instead a system that gives every citizen the same constitutional rights and the same freedom to choose where to live.&lt;br /&gt;9. Freedom to Form Groups. The right of citizens to form groups must be guaranteed. The current system for registering nongovernment groups, which requires a group to be “approved,” should be replaced by a system in which a group simply registers itself. The formation of political parties should be governed by the constitution and the laws, which means that we must abolish the special privilege of one party to monopolize power and must guarantee principles of free and fair competition among political parties.&lt;br /&gt;10. Freedom to Assemble. The constitution provides that peaceful assembly, demonstration, protest, and freedom of expression are fundamental rights of a citizen. The ruling party and the government must not be permitted to subject these to illegal interference or unconstitutional obstruction.&lt;br /&gt;11. Freedom of Expression. We should make freedom of speech, freedom of the press, and academic freedom universal, thereby guaranteeing that citizens can be informed and can exercise their right of political supervision. These freedoms should be upheld by a Press Law that abolishes political restrictions on the press. The provision in the current Criminal Law that refers to “the crime of incitement to subvert state power” must be abolished. We should end the practice of viewing words as crimes.&lt;br /&gt;12. Freedom of Religion. We must guarantee freedom of religion and belief and institute a separation of religion and state. There must be no governmental interference in peaceful religious activities. We should abolish any laws, regulations, or local rules that limit or suppress the religious freedom of citizens. We should abolish the current system that requires religious groups (and their places of worship) to get official approval in advance and substitute for it a system in which registry is optional and, for those who choose to register, automatic.&lt;br /&gt;13. Civic Education. In our schools we should abolish political curriculums and examinations that are designed to indoctrinate students in state ideology and to instill support for the rule of one party. We should replace them with civic education that advances universal values and citizens’ rights, fosters civic consciousness, and promotes civic virtues that serve society.&lt;br /&gt;14. Protection of Private Property. We should establish and protect the right to private property and promote an economic system of free and fair markets. We should do away with government monopolies in commerce and industry and guarantee the freedom to start new enterprises. We should establish a Committee on State-Owned Property, reporting to the national legislature, that will monitor the transfer of state-owned enterprises to private ownership in a fair, competitive, and orderly manner. We should institute a land reform that promotes private ownership of land, guarantees the right to buy and sell land, and allows the true value of private property to be adequately reflected in the market.&lt;br /&gt;15. Financial and Tax Reform. We should establish a democratically regulated and accountable system of public finance that ensures the protection of taxpayer rights and that operates through legal procedures. We need a system by which public revenues that belong to a certain level of government—central, provincial, county or local—are controlled at that level. We need major tax reform that will abolish any unfair taxes, simplify the tax system, and spread the tax burden fairly. Government officials should not be able to raise taxes, or institute new ones, without public deliberation and the approval of a democratic assembly. We should reform the ownership system in order to encourage competition among a wider variety of market participants.&lt;br /&gt;16. Social Security. We should establish a fair and adequate social security system that covers all citizens and ensures basic access to education, health care, retirement security, and employment.&lt;br /&gt;17. Protection of the Environment. We need to protect the natural environment and to promote development in a way that is sustainable and responsible to our descendents and to the rest of humanity. This means insisting that the state and its officials at all levels not only do what they must do to achieve these goals, but also accept the supervision and participation of non-governmental organizations.&lt;br /&gt;18. A Federated Republic. A democratic China should seek to act as a responsible major power contributing toward peace and development in the Asian Pacific region by approaching others in a spirit of equality and fairness. In Hong Kong and Macao, we should support the freedoms that already exist. With respect to Taiwan, we should declare our commitment to the principles of freedom and democracy and then, negotiating as equals, and ready to compromise, seek a formula for peaceful unification. We should approach disputes in the national-minority areas of China with an open mind, seeking ways to find a workable framework within which all ethnic and religious groups can flourish. We should aim ultimately at a federation of democratic communities of China.&lt;br /&gt;19. Truth in Reconciliation. We should restore the reputations of all people, including their family members, who suffered political stigma in the political campaigns of the past or who have been labeled as criminals because of their thought, speech, or faith. And in Hong Kong, a version with GPS and 3.5g integrated edition appears in market.
